End-User License Agreement

This End-User License Agreement is between you (either an individual or an entity) and Kissmetrics, and governs your use of the Kissmetrics application ("Software") that connects with QuickBooks.

1. License Grant

We grant you a non-exclusive, non-transferable, revocable license to use the Software solely for your business needs involving QuickBooks.

2. Restrictions

You may not:

• Modify, reverse engineer, or decompile the Software.
• Resell or distribute the Software without written consent.
• Use the Software in violation of applicable laws or QuickBooks' terms.

3. Ownership

The Software is licensed, not sold. We retain all rights, title, and interest in the Software.

4. Integration with QuickBooks

By using the Software, you authorize us to access and manipulate your QuickBooks data strictly for invoice and customer operations.

5. Termination

We may terminate this license if you breach any terms. Upon termination, you must stop all use and uninstall the Software.

6. Disclaimer

The Software is provided "as is" without warranties of any kind. We are not liable for any data loss, system failure, or errors resulting from the use of the Software.

7. Limitation of Liability

In no event shall Kissmetrics be liable for indirect, incidental, or consequential damages arising out of the use or inability to use the Software.
